Who this covers
This policy is required by Washington's My Health My Data Act, Nevada's consumer health data law (SB 370) and Connecticut's Data Privacy Act. We apply it to everyone in the United States, and we treat everything you log in Her Good Days as consumer health data, whether or not a law calls it that.
It is published by Asper Digital, LLC, 651 N Broad St Ste 201, Middletown, DE 19709-6402, United States. Our privacy policy covers everything else, including California.
The health data we collect
With Private mode (no account), your logs stay on your phone and we receive none of them.
| Category | Examples | When we receive it |
|---|---|---|
| Reproductive and sexual health | Period and cycle days, flow, spotting, ovulation tests, temperature, cervical fluid, sex, the fertile-window estimate, pregnancy week, contractions, kicks | Only if you turn on backup with an account |
| Symptoms and conditions | Hot flashes, night sweats, cramps, headaches, mood, notes you write | Only with backup |
| Body and lifestyle | Sleep, weight, food, water, activity, habits, medication and supplement doses | Only with backup |
| Your life stage | Periods, trying to conceive, pregnancy, after birth, perimenopause, menopause, teen mode | With an account, as a setting |
| Sharing summary | Days to your next estimated period, your fertile window, your pregnancy week, a status you set | Only if you turn on Share with someone, for the items you pick |
| Questions you type in Ask | Any health details you choose to put in a question | When you use Ask; we pass it to Google (Gemini API) for an answer and don't keep it |
| Data inferred from the above | Weekly report numbers, cycle length averages, estimates | Only with backup |
| Use of the app | Which screens you open and which kind of log you saved ("a sleep log was saved"), never the value | While you use the app |
| Visits to this website | Visiting a page about a life stage, a pregnancy week, a tool or a quiz | When you visit; analytics only if you accept them |
Where it comes from
- From you, when you log or set something in the app.
- From Apple Health or Health Connect, only for the types you allow.
- From this website, when you visit it. The calculators and quizzes work in your browser and do not send what you type to us.
We do not buy health data or receive it from other companies.
Why we collect it and how we use it
- To store your logs on our server and in encrypted backups, and restore them on a new phone, when you turn on backup.
- To show your history, weekly report and doctor report in the app.
- To show the summary you picked in the app of the one person you chose, when you turn on Share with someone.
- To answer a question you type in Ask, from excerpts of our own articles.
- To see which features get used and fix errors, from usage events that hold no values.
- To answer you when you write to us.
We do not use it for advertising, to pick shop products for you, or to decide anything about you.
What we share, and with whom
We share consumer health data in one case only: Share with someone, if you turn it on.
| Category shared | Category of third party |
|---|---|
| The summary you pick: days to your next estimated period, your fertile window, your pregnancy week, a status you set | One adult you name, in their own Her Good Days app |
Specific affiliates: none. We have no affiliates that receive consumer health data. We may disclose data if a law or a court order requires it, and only what it requires.
Companies that process it for us
These companies work on our instructions under a contract and may not use the data for anything else. These laws do not count them as sharing.
| Who | What for |
|---|---|
| Amazon Web Services (AWS), US East (N. Virginia) | Hosts our server, the health database and its encrypted backups |
| Our email provider (Amazon Simple Email Service) | Sends sign-in codes and the emails you ask for; it never receives your logs |
| Google (Gemini API), Google LLC | Writes the answers in Ask from our articles, if Ask is available to you. It receives only the question (emails and phone numbers removed), never your account, device or logs. It may process the question in the USA or other countries, keeps it up to 55 days to spot misuse, and doesn't use it to train its AI |
| Cloudflare | Network and security in front of the app's server and this website |
| ElasticFunnels | Hosts this website and records the pages visited |
| Google Analytics | Counts visits to this website. On health pages only after you accept analytics, wherever you are |
No third party collects consumer health data from our app over time and across other websites. On this website, Google Analytics runs on health pages only after you accept it.
Ads from Google, where the app shows them, receive no consumer health data. The ad request holds phone details, the IP address, the ad spot and, after a general article about fitness, food, sleep or general wellbeing, that article's topic words and public address; never your logs, life stage, goals or questions. No ad shows in teen mode or Private mode, and you can turn them off in You › Privacy. Details: If ads are shown to you.
What we never do
- Sell your health data.
- Share it with anyone except the one person you choose with Share with someone.
- Use it for ads or to choose ads, or put tracking code from other companies in the app or on our health pages. The app's only advertising code is Google's, for non-personalized ads that never receive your health data.
- Place a geofence within 2,000 feet (Washington) or 1,750 feet (Nevada and Connecticut) of a place that provides in-person health care, mental health or reproductive or sexual health services, to identify or track anyone, collect data, or send a message or ad.
- Show your logs to staff as routine. Opening them needs a separate, logged permission.
Your consent
Backup is off until you turn it on. The app asks for it on its own screen, with an unticked box.
Share with someone is a separate consent. It is off until you agree on a screen that lists the exact summary items, says that only the one adult you name can see them, and says you can stop it in You › Sharing. The fertile window is its own unticked yes. Each change of items is recorded as a new consent, and stopping is recorded as a withdrawal.
Each consent screen states the categories, the specific use, who receives them, and how to withdraw. If we ever wanted to share health data in any other way, we would ask you separately first. We will never ask to sell it.
You can withdraw at any time in You › Privacy or You › Sharing. We stop processing the server copy at once, and in any case within 15 days, and delete it; your phone keeps its own.
Teens
Teen mode (13 to 17) has no shop, no marketing and no Share with someone. We never sell a teen's data, use it for ads or profiling, or process it beyond what is needed to run the app she asked for.
Your rights
- Know and access: whether we collect, share or sell your consumer health data, a copy of it, and a list of every third party and affiliate that received it, with an email or web contact for each.
- Delete: your health data on our server and with our processors, and in our backups as they roll over (within 6 months).
- Withdraw consent to collecting or sharing it, at any time.
- Correct it, in the app or by writing to us.
- Appeal if we say no.
We will not treat you differently, or charge you more, for using these rights.
How to use your rights
- In the app: You › Privacy to download your data or turn backup off, You › Sharing to stop sharing, You › Delete account to delete everything.
- On this website: Delete your account.
- By email: [email protected] from the address on your account. From another address, we first ask you to show the account is yours.
We answer within 45 days, and tell you if we need up to 45 more. If we turn a request down, reply with "Appeal" in the subject and we will answer in writing within 45 days. If you are still unhappy, you can contact your state attorney general:
- Washington: atg.wa.gov
- Nevada: ag.nv.gov
- Connecticut: portal.ct.gov/ag
Changes to this policy
We review this policy whenever the app changes what it collects or shares. If a change is material, we tell you in the app and by email to the address on your account before it applies, and put the new effective date at the top of this page.
